Terms of Use

1. Agreement and scope

These Terms of Use (“Terms”) are an agreement between you and HorizonMade Technology, LLC, doing business as HorizonMade (“HorizonMade,” “we,” “us,” or “our”). They govern your access to and use of horizonmade.net and HorizonMade consumer applications, including Anchored in Hope, Anchored Behind the Badge, Anchored Behind the Ladder, WalkUpJam, I Need News, and I Need Puzzles (collectively, the “Apps”).

By accessing the website, downloading or using an App, making a purchase, starting a subscription, or submitting information, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website or Apps.

Business use of Align is governed by the Align Business Terms of Use, the Align Privacy Policy, and any applicable signed agreement.

2. Eligibility and accounts

You must be legally able to agree to these Terms. If you use an App for or on behalf of another person, team, organization, or event, you represent that you have authority and all permissions necessary to do so.

You are responsible for your device, Apple Account, credentials, settings, purchases, content, and activity. You must protect your credentials and promptly address suspected unauthorized access.

3. Website purpose and submissions

HorizonMade develops and publishes software products. The website provides information about HorizonMade and its products and allows visitors to submit general, non-confidential problems, ideas, feedback, questions, and product-support messages. It is not an offer for commissioned development, staff augmentation, general business consulting, or an open-ended customer-directed development arrangement.

Any idea, problem description, suggestion, feedback, or other material you voluntarily submit (“Submission”) will be treated as non-confidential and non-proprietary. Do not send trade secrets, proprietary processes, unreleased product information, source code, customer or employee records, personal data, or information you are not authorized to disclose.

You retain rights you may have in the original expression of a Submission. By submitting it, you grant HorizonMade a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, transferable, and sublicensable right to use, reproduce, adapt, summarize, combine, disclose, develop from, and otherwise use the Submission for product evaluation, development, operation, marketing, and other lawful business purposes.

HorizonMade may already be considering or developing the same or a similar concept. A Submission does not require HorizonMade to review, respond, develop, provide exclusivity, preserve confidentiality, compensate, or credit you.

4. App license and Apple terms

Subject to these Terms and applicable purchase conditions, HorizonMade grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use an App on Apple-branded devices you own or control, as permitted by Apple’s usage rules, for personal and lawful purposes.

Your license is to the App, not a sale of ownership. HorizonMade and its licensors retain all rights not expressly granted. Apple is not responsible for an App’s maintenance, support, warranties, claims, or intellectual-property disputes except as required by Apple’s applicable terms.

Unless a custom end-user license agreement is presented for an App, the Apple Standard EULA also applies. If these Terms conflict with a mandatory Apple term, the mandatory Apple term controls to the extent of the conflict.

5. Anchored wellness applications

Anchored in Hope, Anchored Behind the Badge, and Anchored Behind the Ladder provide general educational, faith-oriented, reflection, journaling, grounding, and wellness-support features. They are not medical devices and do not provide diagnosis, treatment, psychotherapy, crisis intervention, emergency response, pastoral counseling, legal advice, or professional healthcare advice.

Content is not a substitute for a physician, licensed mental-health professional, counselor, clergy member, employer support program, emergency responder, or other qualified professional. Do not delay or disregard professional care because of an App.

The first-responder Apps are independent HorizonMade products. They are not endorsed by, affiliated with, or official services of any police department, fire department, emergency agency, government body, union, or employer.

6. Crisis and emergency use

The website and Apps are not emergency services and are not monitored for crisis messages. If you or another person may be in immediate danger, call 911 or the applicable local emergency number. In the United States, you may call or text 988 for the Suicide & Crisis Lifeline.

Do not rely on an App, journal entry, notification, exercise, scripture selection, soundscape, or other feature for an emergency, safety-critical decision, or mandatory workplace report.

7. Health, privacy, and workplace decisions

HealthKit, heart-rate, check-in, journaling, reflection, or similar information may be incomplete, delayed, inaccurate, or unavailable. You are responsible for deciding whether and how to use those features and for consulting qualified professionals when appropriate.

HorizonMade does not send journal content or check-ins to an employer or department unless a future feature clearly tells you and you choose to share it. You are responsible for any content you voluntarily export, display, or share. An App does not override employer rules, reporting obligations, department policy, or law.

8. WalkUpJam

You are responsible for player and team information, photographs, voice recordings, announcements, and other content you add to WalkUpJam. You represent that you have the rights and permissions needed to use that content, including parental or guardian permission when appropriate.

Music availability and playback may depend on Apple Music, your subscription, your library, internet access, region, device, and Apple’s terms. Access to a recording or music library does not necessarily grant the right to perform that music publicly.

You are responsible for obtaining any licenses, permissions, or approvals required for music playback, announcements, player names, photographs, recordings, and public-event use. HorizonMade does not grant music synchronization, public-performance, reproduction, broadcast, or other third-party rights.

9. I Need News

I Need News may display headlines, summaries, links, location-based results, and other material supplied by third-party news sources. Content may be delayed, incomplete, inaccurate, unavailable, or changed without notice.

HorizonMade does not endorse every article, viewpoint, publisher, or linked website. News content is provided for general informational purposes and should not be treated as professional, legal, medical, financial, safety, or emergency advice.

10. I Need Puzzles

You may use photos and other images only when you own them or have permission to use them. You may not use the App to create, distribute, or display unlawful, abusive, exploitative, infringing, or privacy-violating content.

Game Center features are also subject to Apple’s applicable terms and settings.

11. Purchases and subscriptions

Certain Apps may offer optional in-app purchases or auto-renewable subscriptions. The price, duration, included features, trial terms, and renewal terms will be displayed before purchase.

• Payment is charged through the user’s Apple Account.
• Subscriptions renew automatically unless canceled through Apple before renewal.
• Users can manage or cancel subscriptions in their Apple Account settings.
• Deleting an App does not automatically cancel a subscription.
• Refund requests are governed by Apple’s policies and applicable law.
• Purchased access may be restored using Apple’s restoration features when available.

HorizonMade may change subscription features or future pricing as permitted by Apple and applicable law. Any required notice or consent will be provided through Apple or the App.

12. Notifications and online services

App reminders are provided for convenience and may be delayed, blocked, or unavailable. Do not rely on an App notification for medication, emergency, safety, employment, or other time-critical decisions.

Features relying on Apple Music, iCloud, news providers, Game Center, internet access, or other third-party services may become unavailable or change without HorizonMade’s control.

13. Prohibited conduct

You may not:

• Copy, modify, distribute, sell, lease, sublicense, or commercially exploit the website or an App except as expressly permitted;
• Reverse engineer or attempt to extract source code except where applicable law expressly permits it;
• Bypass security, subscription, access, or technical restrictions;
• Use the website or an App to violate law or another person’s rights;
• Upload malware or interfere with the website, an App, or a related service;
• Submit unlawful, misleading, infringing, confidential, defamatory, malicious, or harmful material;
• Scrape or access the website in a way that creates an unreasonable burden;
• Misrepresent an App as an official emergency, medical, department, government, or news service; or
• Use the website or an App in a way that could harm HorizonMade, Apple, another provider, or another person.

14. HorizonMade content

Unless otherwise stated, the website, Apps, text, graphics, logos, product names, designs, software, and other HorizonMade content are owned by or licensed to HorizonMade and protected by applicable intellectual-property laws.

You may access the website for personal or internal informational use. No other rights are granted except as expressly stated in these Terms.

15. Availability and changes

Descriptions of planned, current, or future products are informational and do not guarantee availability, features, pricing, compatibility, support, or release dates.

HorizonMade may add, modify, suspend, or discontinue website content or App features. We do not guarantee that every feature, integration, news source, song, or online service will remain available or work on every device or operating-system version.

16. Third-party services and links

The website and Apps may contain links to or rely on third-party services. HorizonMade does not control third-party content, availability, security, privacy practices, or terms and is not responsible for those services.

17. Disclaimer of warranties

To the maximum extent permitted by law, the website and Apps are provided “as is” and “as available.” HorizonMade disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted or error-free operation.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

18. Limitation of liability

To the maximum extent permitted by law, HorizonMade and its members, managers, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost opportunities, personal decisions, employment consequences, or third-party content arising from the website, an App, or a Submission.

To the maximum extent permitted by law, HorizonMade’s total liability relating to an App will not exceed the greater of the amount you paid for that App during the twelve months before the event giving rise to the claim or one hundred United States dollars.

19. Termination

These Terms remain effective until terminated. Your App rights may terminate if you materially violate these Terms. Upon termination, you must stop using the applicable App. Provisions that by their nature should survive will remain effective.

20. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Subject to mandatory consumer law, disputes will be brought in the state or federal courts serving Wake County, North Carolina.

21. Changes to these Terms

HorizonMade may update these Terms to reflect changes to the website, an App, legal requirements, or business practices. The revised Terms will display an updated effective date. Material changes may also be communicated through an App or another appropriate notice.

Continued use after the effective date constitutes acceptance where permitted by law.
